Terms and Conditions

1. Scope

These terms govern every contract concluded between EKKE'S (the "Seller", see Legal Notice) and the customer through the ekkes.ch website. By placing an order you confirm you have read and accepted these terms.

2. Eligibility

You must be at least 18 years old to purchase. The Seller reserves the right to refuse any order it suspects is for a minor. The carrier may verify the recipient's age on delivery.

3. Products

EKKE'S Artisanal Rhum Punch is an alcoholic beverage at 19.2% ABV, in 700ml bottles. Photos are illustrative; minor variations in label or batch may occur.

4. Prices

Prices are shown in Swiss francs (CHF), including the applicable Swiss alcohol tax. Shipping is calculated at checkout and is free for orders of 12 bottles or more.

5. Order formation

A contract is concluded when the Seller confirms acceptance of your order by email. The Seller may refuse an order without giving reasons, in which case any payment already taken is refunded in full.

6. Payment

Retail orders are paid online via SumUp (cards, TWINT, Apple Pay where available). Approved wholesale customers may pay by Net-30 invoice, with a payment reference on the QR-bill enclosed.

7. Delivery

We ship within Switzerland via Swiss Post, DHL, or UPS. Standard delivery is 2 to 3 business days from payment. We currently do not ship abroad.

8. Right of withdrawal

You have 14 days from receipt to withdraw from the contract without giving reasons, provided the product is unopened, undamaged, and in its original packaging. Email hello@ekkes.ch to start a return. We refund the purchase price (including standard shipping) within 14 days of receiving the returned goods.

9. Warranty

The Seller warrants the product is free from defects on delivery, per Art. 197 ss of the Swiss Code of Obligations. Notify the Seller within 7 days of receipt for any defect. The Seller may, at its choice, replace, refund, or repair.

10. Liability

The Seller's liability is limited to direct damages and capped at the value of the order, except in cases of intent or gross negligence. No liability is accepted for the consequences of inappropriate consumption.

11. Intellectual property

The EKKE'S name, logo, and all site content are protected by Swiss and international intellectual property law. Reproduction without prior written consent is prohibited.

13. Applicable law and jurisdiction

These terms are governed by Swiss substantive law, excluding conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. Sole jurisdiction lies with the ordinary courts of the canton of Vaud, Switzerland, subject to mandatory consumer protection rules.

14. Updates

The Seller may amend these terms. The version in force at the moment of order is the one that applies to that order.
